Written by an experienced property law barrister, Tom Weekes, Property Notices: Validity and Service is separated into seven parts: identifying the requirements of a valid notice; the interpretation of notices; common issues; waiver, estoppel and withdrawal of notices; service at common law; service under contractual provisions; and service authorised by statute. Whilst this logically leads the reader through the various issues, it can be difficult for an unfamiliar reader to dip in and out of the text. Property Notices: Validity and Service is well written and clearly explains the important principles. Where appropriate, the author includes extracts from the statutory provisions or leading judgments explaining how the courts have applied the principles. Impressively, Property Notices: Validity and Service includes two excellent appendices; the first lists the key authorities and their principles allowing the reader to quickly consider the relevant case law and the second includes the important House of Lords judgment from Mannai Investment Co Limited v Eagle Star Life Assurance Co Limited [1997] 3 All ER 352. For anyone practising in this area of law, Property Notices: Validity and Service is an important and vital text. It clearly explains the key principles in a logical and accessible way meaning the reader can quickly apply the principles. Whilst the author does not, unfortunately, include any precedent notices (and takes the positive step not to do so), it is an extremely practical and useful text for anyone needing to serve or advise on property notices.
