As
any commercial or civil litigator will be aware, boundary disputes between
neighbours are relatively common. In the words of Peter Gibson LJ in
Clarke v O’Keefe (1997) 80 P.
& C.R. 126 “there are
few disputes that raise passions mare than boundary disputes”.
It therefore important that the basic issues are addressed quickly
in an attempt to quell the tempers of the respective neighbours.
This is where the text comes into its own - it provides an
extremely practical and accessible account of the issues which commonly
arise in boundary disputes. One
of the excellent features of the text is that it provides a number of
diagrams and tables throughout the text.
For example, chapter four includes a extremely useful table on the
repairing obligations on walls. The
text also includes the extremely useful legislation and statutory
instruments at the back of the text which makes the text a one-stop
practical and comprehensive guide to boundary disputes. The
text is well laid out and useful headings mean that the material can be
located quickly. The text also
makes reference to the relevant statutory provisions and/or case law.
This is an excellent idea as it enables the reader to conduct
further reading should more consideration be required.
One fantastic new addition to the text is that it includes the
provisions of the Anti Social
Behaviour Act 2003 in respect of the height of trees which is becoming
a commonly used procedure to reduce the overhang of trees and hedges. In conclusion, this is an excellent text which provides a clear and concise account of the law relating to boundaries.
