Written by contentious probate lawyers, Probate Disputes and Remedies is split into six parts: pre-death issues; death and burial disputes; obtaining the grant - disputes and resolution; problems with the will; disputes in estate administration; and claims against professional advisors. The appendix also includes a number of excellent precedents which can be quickly adapted to meet the specific circumstances of a practitioner's case. By adopting this approach (which is excellent), the authors ensure the reader is logically guided through the material and can quickly find the relevant part. Probate Disputes and Remedies is superbly written. It always has the practitioner in mind meaning that each paragraph is both concise and suitably referenced. This allows the reader to focus on the real issues so a client is properly advised. Amongst the excellent precedents is a precedent letter of advice dealing with applications under the Inheritance (Provision for Family and Dependents) Act 1975 which can be quickly adapted to provide a thorough and readable advice. Its approach, by highlighting the problems encountered in practice and discussing the advantages and disadvantages of courses of action, is also excellent meaning the practitioner can avoid encountering such problems. For anyone practising or dabbling in contentious probate, Probate Disputes and Remedies is a necessary text. It is well balanced and superbly written meaning it can be used by both experienced and inexperienced practitioners. Its combination of a problem solving approach together with the excellent precedents also means the practitioner can provide extra value which other practitioners may not.
