For any disputes or commercial contracts lawyer, a solid understanding of exclusion or limitation of liability clauses is fundamental.  Without this, reliance may be placed on contracts which contain the most onerous clauses.  Fortunately, Exclusion Clauses and Unfair Contract Terms considers the whole raft of clauses and comments on their enforceability (or not) and the Court's current thinking: this approach is invaluable.

Written by an experienced commercial lawyer, Exclusion Clauses and Unfair Contract Terms is well written and accessible meaning it is an ideal for both experienced and inexperienced practitioners.  It is also extremely readable meaning students will also find it of considerable help.  Lawson also commonly states the full wording of the exclusion clause and explains the decision: this is essential.  Similarly, the text is well structured allowing the reader to quickly find the relevant section rather than cross-referring throughout the text.

Unlike similar texts or sections in contract law texts, Exclusion Clauses and Unfair Contract Terms is extremely practical.  It rarely departs from the practical approach and only explains the development of the law when appropriate.  This allows the busy practitioner to quickly understand the important principles.  It is also incredibly up to date and includes a newly written chapter on the important Consumer Protection from Unfair Trading Practices Regulations 2008 which came into force in May 2008: most other texts have yet to catch up!

Exclusion Clauses and Unfair Contract Terms is a text that no disputes or commercial contracts lawyer can do without.  It explains the principles, case-law and various different exclusion clauses in a practical and accessible way.  By doing so, the text can be used by both experienced and inexperienced practitioners and also students keen to develop their knowledge in this practically important area of law.  An extremely welcome addition to any law library!
